IP IDENTIFICATION SERVICES
01
PRELIMINARY IP AUDIT
A preliminary IP audit is a starting point for professionals and businesses of all sizes that need to determine what their IP portfolio contains. This phase typically includes a review of your website, products, and/or services to:
-
Determine if there are trademarks that need protection
-
Identify items that might be copyrightable or patentable
-
Verify if your existing IP assets are in good standing (including paying maintenance and renewal fees)
02
IP STRATEGY
Once we have a clear understanding of your current IP assets, it’s time to develop a strategy. Kim’s IP counseling varies for every client and foreign associate’s case, but generally, it can include:
-
Guidance on where and what to file to provide the greatest protection in the U.S. and around the world
-
Securing different and overlapping types of protection when necessary (i.e., patent, trademark, copyright)
-
Varied scope of protection when applicable (e.g., a name and logo, a method or system, etc.)
03
IP PORTFOLIO MANAGEMENT
Armed with a clear vision and strategy for your IP portfolio, Kim will remain your partner to manage and maintain your assets to ensure future protection as your business grows. Depending on your particular property, needs, and goals, this can include:
-
IP Searching: A clearance or freedom to operate (FTO) search uncovers if a trademark is registerable (i.e., are there already confusingly similar names out there?), if there is room in a crowded market for a new product, and if a planned activity infringes another’s IP. Patentability and infringement searches help determine if a technology is patentable and if someone else infringes on your IP, respectively.
-
Filing: As the name implies, this covers the filing of patents, trademarks, and copyrights for your existing IP and new products or services as you add them.
-
Prosecution: Kim will advocate on your behalf (or that of your client, in the case of foreign associates) before the relevant government office between filing and patent granting or copyright/trademark registration.
-
Watch Services: Also known as trademark monitoring services, this involves looking for filings by others—both in the U.S. and internationally—that might interfere with your or your client’s IP (e.g., logos and names that are too close).
-
Maintenance: With Kim as your IP attorney, your issued patents and registered trademarks will be maintained worry-free! She will handle fee payments and filings as they are due at certain intervals to keep the IP from becoming abandoned.
